Terms and Conditions under which JR Network Solutions (herein called JRNS) sells products to customers (herein called Customer).

When placing an order with us, where we are to deliver goods to you, we require a physical street address. To assist us in processing your order, please also provide your land-line phone number. Delivery is via courier and cannot be to a Post Office Box. Please note that an authorized signatory needs to be at the delivery address to sign for and collect the goods, and that photo identification may be requested.

Insured delivery charges are: $15 for anywhere in Australia up to 3kg.
Delivery charges of goods over 3kg will be calculated after you have placed your order, and we will notify you of the cost.

JRNS, as supplier and seller of computer components and peripherals and the distributor of new computer systems, provides goods and warranties according to the conditions as described below.

All prices quoted are GST inclusive. Prices are subject to change without notice. Omissions and errors are excepted.

If quotations are provided they are valid for a period of 7 days from the date shown on the quotation unless otherwise specified in writing by JRNS.

In the event that the prevailing exchange rate between the currency of the country of origin and the currency quoted has fluctuated from the time the quotation is rendered to the time of payment is received from the Customer, JRNS reserves the right in its sole discretion to adjust any prices quoted herein and the customer agrees to meet the revised price. For the purpose of this contract, the prevailing exchange rate at the time of the quotation shall be the rate specified, (at the time payment is received) to be that issued by the National Australia Bank for a spot transaction on that day.

All Products shall be paid for before delivery or if JRNS and the Customer agree on and maintain a credit arrangement, by the terms and conditions of said arrangement.

Property of the Products shall remain with JRNS and shall only pass to the Customer upon the payment of the purchase price in full. Prior to payment of the purchase price in full, the Customer shall hold the Products as bailee for JRNS. In the event of the Products whether in the same or a modified form being disposed of prior to the payment of the purchase price in full, any amount received by the Customer shall be held in trust by the Customer for JRNS.

All prices quoted are in Australian dollars, unless otherwise specified.

So far as the law permits JRNS shall not be liable in any way whatsoever for any indirect or consequential loss, or loss of profit or any liability for damage to property or death of or injury to persons howsoever caused including, but not limited to, any loss by reason of delay, defective or faulty Products or workmanship, negligence or any act, matter or thing, done permitted or omitted by JRNS.

These Terms and Conditions of Sale shall apply to the sale and purchase of the Products except where modified herein by JRNS or except where JRNS and the Customer are parties to a current written agreement which governs the sale and purchase, in which latter case the provisions of the said Agreement shall prevail.

Unless otherwise specified, Products are located in Melbourne, and delivery shall take place at the time of the physical taking of the Products by the Customer or by the carrier whether engaged by JRNS or the customer or 10 days after JRNS notifies the Customer that the Products are ready for delivery, whichever first occurs. Where the Customer arranges its own carrier, it shall be responsible for all freight, insurance and other costs associated with the carriage. Where JRNS arrange carriage, all freight, insurance and other costs shall be to the account of the Customer.

New Products: JRNS warrants that Products under normal use and service will be free from defects in materials and workmanship for the period of warranty provided for each Product described from the date of shipment to Customer. JRNS will, without charge to Customer, promptly repair or replace, at its option, any parts which are determined to be defective within this warranty (excluding expendables) and which are returned to JRNS provided:

(1) Customer shall have notified JRNS of any alleged defect within the warranty period;

(2) the Product has not been damaged, subject to misuse, altered or repaired or improperly maintained by the Customer or others in a manner which JRNS reasonably determines to have adversely affected performance or reliability.

JRNS' liability hereunder is limited to the repair or replacement of the defective Product and does not include any labour related to the subsequent installation thereof. The above warranties extend solely to Customer and all warranty claims must be generated by the original Customer. Repair or replacement of component parts shall not extend nor decrease the Equipment warranty.

Repairs: With the exception of the warranty period (repairs are warranted for 30 days), new products terms and conditions apply.

All conditions and warranties however expressed or implied are expressly excluded to the full extent permitted by law. So far as the law permits, the liability of JRNS for a breach of a condition or warranty or for any negligent act or omission is limited at JRNS' option to the replacement or rectification of the Product or supply of equivalent Product or the cost of replacing or rectifying the Product or of acquiring equivalent Product.

Defective component(s) or system(s) within their respective warranties may be returned to JRNS subject to the conditions outlined below:

1. If you are shipping a system or a hard drive or other device containing data, you are responsible for backing up such data prior to shipment. JRNS will not be responsible for data lost during the course of shipment, repair or replacement.
2. All costs of returning defective parts or systems to JRNS, including insurance, must be paid by the purchaser.
3. If JRNS determines that failure of the part(s) or system(s) was not a result of a defect in materials or workmanship, JRNS reserves the right to charge you for parts and labour at JRNS's then current labour rate. A minimum charge of $25 will apply to items returned for warranty and no fault is found. JRNS will advise you prior to assessing these charges.

Customer shall not return any JRNS Product for credit, exchange or otherwise without the prior issuance by JRNS of a JRNS Return Merchandise Authorisation ("RMA"). Returns must be received by JRNS within 10 days of the issuance of the RMA and this period cannot be extended or re-issued. Customer will pay for the freight charges on the return and JRNS will send back the product at our expense.

If any of the terms and conditions hereof shall to any extent be invalid or unenforceable, the remainder of these the Terms and conditions, or the application of such the terms and provisions to persons or circumstances other than those as to which it is held unenforceable shall not be affected thereby.

The validity, interpretation and performance of this Agreement shall be governed by the laws of the Victoria, Australia.

These terms and conditions of sale do not affect any statutory warranty that may be available to Customer.

JRNS disclaims all responsibility for the information and all liability (including without limitation, liability in negligence) for all expenses, losses, damages and costs Customer may incur as a result of information being inaccurate or incomplete in any way for any reason.

This disclaimer shall take effect to the fullest extent permitted by law.
